Update on Impact Racing Product Decertification by SFI

Update on Impact Racing Product Decertification by SFI.

March 29, 2010 - UPDATE ON IMPACT RACING PRODUCT DECERTIFICATION

On Friday, March 26, 2010, SFI filed suit in the United States District Court for the Southern District of Indiana against Impact Racing, LLC, based upon evidence SFI has received regarding Impact’s manufacture and use of counterfeit SFI conformance labels and patches. Such actions by a manufacturer directly violate its obligations to the SFI program. SFI took similar action when it joined in Hans Performance Products’ lawsuit against Impact due to Impact’s manufacture and use of counterfeit Hans helmet clips. In that case, Impact counterfeited the clips and inscribed an SFI rating on the clips without SFI knowledge or approval. As in the Hans clip case, SFI is asking for another Temporary Restraining Order and Preliminary Injunction against Impact. SFI is also seeking monetary damages. Please see SFI’s web posting of March 26, 2010 for more details on the basis for SFI’s position. At this time we do not know the exact extent of these counterfeiting activities, but through the litigation process we hope to learn all the details. During the years that Impact was using the counterfeit labeling, it was also obtaining authentic patches and labels from SFI. At this time SFI does not know how many products have counterfeit labels and patches and which ones have authentic labels and patches. Therefore, it was unfortunately necessary to decertify all the products manufactured by Impact pursuant to SFI specifications 3.2A, 3.3, 16.1 and 16.5. Please note that Impact helmets are not affected by this decertification.

It is important to keep in mind that any such use of counterfeit labeling is in violation of the SFI specification programs. Whether it involves counterfeit helmet clips or counterfeit labeling, such activities can undermine the integrity of the product ratings system that exists in motorsports. This system depends upon trust. If this system is damaged, all of motorsports can suffer the consequences. Manufacturers that agree to the SFI specification programs must meet rigorous and strict requirements. Those stringent standards are in place first and foremost to promote safety and product reliability. Racers and sanctioning bodies must have confidence in a manufacturer’s representation that its products are in compliance with SFI requirements. The conformance label is a manufacturer’s solemn statement to the racing community that it followed the rules in bringing its product to the sport. When this trust is violated, the racing community suffers. The level playing field for other manufacturers becomes uneven. Sometimes the consequences of a breach of trust are severe and can hurt innocent victims. This is why it is so critical that manufacturers follow the ratings system at all times. SFI will continue to update the racing community as more information becomes available.

March 26, 2010 - NOTICE OF DECERTIFICATION; NOTICE TO CEASE AND DESIST AND TERMINATION OF ALL CONTRACTS OF PARTICIPATION ISSUED TO IMPACT RACING

SFI Foundation, Inc., has issued a Notice of Decertification; Notice of Cease and Desist, and a notice terminating all Contracts of Participation to Impact Racing. Effective April 27, 2010, all products manufactured and/or distributed by Impact Racing pursuant to SFI Specification Programs 3.2A, 3.3, 16.1, and 16.5 are decertified. Evidence obtained by SFI shows that over a period of years Impact Racing has engaged in the production and use of counterfeit SFI conformance labels and patches, and affixed them to Impact products for use in motorsports. Under the Contracts of Participation between SFI and Impact, SFI conformance labels and patches may only be obtained from SFI and no other source. Evidence shows that Impact had counterfeit SFI labels and patches made in Asia and then affixed them to Impact products it distributed to members of the racing community. To SFI’s knowledge, Impact never advised its customers that its products contained phony SFI labels and patches. Impact never advised SFI of its systematic and longstanding practice of counterfeiting and distributing SFI patches and labeling.

Impact has been directed to cease and desist from this practice. SFI has directed Impact to immediately notify all affected customers to remove the counterfeit labeling and to offer the affected customers a full refund of the purchase price. SFI is requesting that all counterfeit conformance labels removed from Impact products be sent to SFI.

SFI has elected not to decertify these products immediately in order to minimize the potential hardships to members of the racing community that have been brought about by Impact’s counterfeiting activities.

SFI has also elected to terminate all Contracts of Participation with Impact Racing effective 90 days from March 24, 2010. Under the terms of the Contracts, either party may terminate the agreements without penalty upon 90 days notice. This means that Impact will no longer be able to participate in any SFI programs after this 90 day period.

SFI has taken these actions in the best interests of the safety and integrity of the racing community. This is in keeping with SFI’s mission and purpose.

With the countdown winding down until the 2010 Formula One season's opening round in Bahrain, the roster of drivers competing for top honors is drawing near completion with the announcement that the Sauber team has signed Pedro de la Rosa as its second race driver.

The Spanish driver started in F1 as a test driver for Jordan in 1998, driving for Arrows and Jaguar before going to McLaren, with whom he stayed as a test driver from 2003 through 2009, filling in for Juan Pablo Montoya in 2005 and 2006. With McLaren now divorced from Mercedes and Sauber from arch-rival BMW, de la Rosa will return to the grid alongside Japanese hot shoe Kamui Kobayashi for the upcoming season.

Following the Sauber announcement, only four seats remain unconfirmed: two at USF1, one at Campos (alongside Bruno Senna) and one at Renault (alongside Robert Kubica). Follow the jump for the press release from Sauber and a standing roster of who'll be driving for which teams this season.

The horrible tragedy in Haiti has hit the world like a sledge hammer, and relief efforts and charitable donations have been flooding into the grief-stricken island. Car companies have been quick to donate money in the wake of the earthquake, and now special edition vehicles are hitting the auction block to provide still more assistance. Chrysler announced that it was donating a 300C with 300 signatures from A-list celebs like Tom Hanks and Merryl Streep (full story coming soon), and now General Motors is following up on its $100,000 cash donation with a special edition Corvette.

The Vette in question is one of 427 Special Edition 2008 Corvette Z06 models with former Corvette Plant Manager Will Cooksey's signature and vehicle number on the center console. The Special Edition Z06 is also the only 2008 model that sports Crystal Red Metallic Tint Coat paint, a Stinger-style stripe on the front hood and fascia and a painted Z06 spoiler. This Vette becomes more prestigious due to the fact that it is the 427th and last copy of the limited series. The Z06 will be auctioned off at the 39th annual Barret-Jackson event on January 23.

As the saying goes - "There's no substitute for seat time". Even know while it still cold and snowy outside you can be getting plenty of seat time in a racing simulator.

Recently, the owner of Northstar Motorsports, John Ruther, has gotten hooked on driving a Racecar Simulator. With the help of Peter Sygieda from Pol-Position Racing (www.polpositionracing.com) and also a member of the Northstar team John has installed the simulator in the garage that houses one of his collector Porsches. Peter already has installed several of these so he knew exactly what parts to order and one of Peter's friends built a computer and did all the software for the system. Ruther says, "I just wanted to be able to practice on a particular track in a car that is very similar to my own Porsche GT3 RS factory racecar. With this system, which utilizes software by R-Factor we were able to start with a pre-programmed Porsche 997 Cup car and then we modified it by putting altered gearing, tire sizes, spring rates etc. The net result is a car that feels all the world like my own racecar." So far we have about 13 different tracks loaded into our system. This system utilizes a Porsche GT3 RS steering wheel, shifter and pedals and we used a corbeau racing seat which is available thru Northstar Motorsports. The total cost including the computer (but excluding the 32" LCD TV) is approximately $1,800. If you are interested email Peter peter@polpositionracing.com and he can get you an exact quotation.

2010 F1 grid comes into focus as Lotus signs Trulli and Kovalainen.

Lotus F1 Racing has today confirmed that Italy's Jarno Trulli, Finland's Heikki Kovalainen and Malaysia's Fairuz Fauzy have joined the team to spearhead driving duties for its debut Formula 1 season in 2010.

There has been much speculation surrounding the identity of Lotus F1 Racing's driver signings in recent weeks, but the appointment of Jarno, Heikki and Fairuz was made formal in an official announcement by Malaysian Prime Minister Dato' Sri Najib Tun Razak in Kuala Lumpur this afternoon, at which Jarno, Heikki and Fairuz were also present.

35-year-old Trulli is one of the most experienced, consistent racers in Formula 1 and unquestionably still one of the fastest men over a single lap. He is one of just a select few drivers to have tasted victory in Formula 1, and that at the jewel in the crown of Formula 1 racing, the Monaco Grand Prix. He has also finished in the top ten of the drivers' Championship table on seven occasions.

Heikki's F1 career began in 2006 when he made his debut as a test driver. His appointment to the Lotus F1 Racing team will see the 28 year old Finn starting his fourth season in the Formula 1 World Championship and he brings with him a race winning reputation, confirmed by his first victory in Hungary in 2008, and a wealth of experience that will make a potent combination with fellow race driver Jarno Trulli and Fairuz Fauzy.

27-year-old Fauzy joins the team having previously held a Formula 1 testing role for the Spyker squad back in 2007. Since then he has driven in the F1 feeder series GP2, the World Series by Renault, as well as being named as lead driver for Malaysia's involvement in the A1GP Championship.

It is a reflection of the determination and status of Lotus F1 Racing to return to Formula 1 that they have hired two race winning drivers for the debut season.

Red Bull to Place Raikkonen, Loeb and Coulthard in Peugeot 908 HDi at LeMans.

Motorsports of late have been gripped by the crossover of racing drivers from one discipline to another, but one of the most established migrations in motor racing has always been between Formula One and Le Mans. The great (but unrelated) Hills – Phil and Graham – both won the F1 championship and Le Mans, but none have done so since Jochen Rindt in 1970. Lately, Peugeot especially has been seeking F1 drivers to pilot its 908 HDi against the venerable Audis at the famous 24-hour race, but that could step up a notch if the latest rumors from France hold any Evian.

Peugeot has registered three factory works cars to challenge Le Mans next year, plus one mystery car that has only been listed as a privateer entry. According to the latest reports, that entry could be fielded by Red Bull. The energy drink company has one of the most comprehensive networks of racing talent under its wings, but what's catching the most attention is three of its most prominent drivers.

Six-time World Rally Champion Sebastien Loeb, whose Citroen C4 rally car is sponsored by Red Bull, has raced Le Mans previously, and has been linked to a return to the endurance race. 2007 Formula One champion Kimi Raikkonen will likewise be driving next year in a Red Bull-sponsored C4 fielded by Citroen (Peugeot's sister company). Finally, David Coulthard was largely responsible for Red Bull's foray into F1, and though retired from actively racing, remains an advisor and test driver for the team.

While these rumors could prove nothing more than exactly that, if Red Bull were to bring these three talents to La Sarthe, they would surely be a force to be reckoned with.

Renault will hold a special board meeting this week to decide on the racing team's fate, and it looks like it may go ahead and just line up a sale right away, instead of announcing a shutdown and then trying work out a sale as Honda and BMW did.

AutoCar reports that Prodrive, which has been trying to break into F1 for several years, may have the inside line on the French outfit. The other primary bidder is Genil Capital, a Luxembourg-based investment fund. The financial group would likely retain the Renault name for the team, while Prodrive would probably run under its own banner. If Prodrive wins out, Renault would remain only as an F1 engine supplier.

Last week came a report that Ms. Patrick had inked a multi-year deal with the recently restructured Andretti Autosport, putting to rest the rumors that the sometime-swimsuit model was headed to NASCAR. Well, Sporting News is now reporting that the gun might have been jumped on that conclusion. It seems that the GoDaddy pitchwoman is about to announce a deal to drive for Dale Earnhardt Jr.'s NASCAR Nationwide Series team in 2010.

SN is reporting that Danica will run the full IndyCar calendar and a limited Nationwide schedule, with GoDaddy sponsoring her stock car. According to the GoDaddy website, the formal announcement will come at 1 PM ET Tuesday, December 8.

After months in limbo, the FIA has released a short statement to announce that it has approved the Sauber F1 team – formerly owned by BMW – to fill Toyota's vacant spot on the grid for next year's F1 championship.

The announcement puts an end to a long period of uncertainty for the Swiss team that started when BMW announced it would withdraw its support. A deal was then penned with a shady investment firm known as Qadbak. But after Qadbak emerged as little more than a shell company for a convicted fraudster, the team's founder and namesake Peter Sauber negotiated a deal to buy the team back from the departing Bavarian automaker.

BMW motorsport chief Mario Thiessen – who supervised the company's F1 participation from providing engines to Williams through its purchase of Sauber – has announced that he'll remain with BMW and not leave with Sauber, leaving old Peter in charge.

The newly independent team has reportedly negotiated a deal to run Ferrari engines next season, an arrangement that powered Sauber F1 cars for eight years, rebadged as Petronas under the sponsor's name. Reports also suggest that Giancarlo Fisichella – who raced for Sauber in 2004 alongside Felipe Massa – could drive for the team once again in parallel to his Ferrari test duties.
